AGI Service Providers

AGI does not disclose Personal Data to third parties, except to process credit card information for orders in accordance with PCI compliance security guidelines. However, at a future time, AGI may need to provide users’ Personal Data to other third parties to deliver specific Online Services to the user (such as hosting services or support Online Services). These third parties will be required to adhere to Safe Harbor Privacy Principles or at a minimum AGI will require the third party to certify that they follow privacy protection equal to AGI’s.

Legal Requirements

AGI does not disclose Personal Data, including the data you enter or upload into the Online Service, unless disclosure is necessary to comply with an enforceable government request such as a warrant.

Change of Ownership

In the event of a change in ownership, or a direct merger or acquisition with another entity, we reserve the right to transfer all of AGI User information, including Personal Data, to a separate entity. We will use commercially reasonable efforts to notify you (by posting on www.agighana.org or via an email sent to the email address you provide) of any change in ownership, merger or acquisition of AGI’s assets by a third party.

Security
All of your Personal Data stored by AGI or otherwise, is considered confidential and private. Appropriate industry standard administrative, physical, and technical safeguards will be maintained by AGI to protect against the loss, misuse and alteration of the information under our control.

AGI shall not: (a) Intentionally modify your Personal Data, (b) Disclose your Personal Data except as compelled by law or as expressly permitted in writing by you, or (c) Access your Personal Data except to provide maintenance, verification, or prevention of technical problems, associated with the Online Service or to provide technical support at your request.

AGI takes reasonable steps to ensure the integrity and security of our network and systems but does not expressly make any guarantee these security measures will prevent third-parties from obtaining Personal Data by illegal actions or attacks. Should such an attack be perpetrated, AGI will supply authorities with available information on the third party when such event comes under prosecution.

Passwords
It is your responsibility to choose secure passwords and to keep them safe. AGI cannot be responsible for Personal Data that is compromised due to an insecure or stolen user password. If you are authenticating with AGI via a third-party (e.g. Google Apps), those passwords must also be secured.

Updating or Removing User Information

You may, at any time, choose to correct or update the information you have submitted to AGI by updating your account on our website or in the Online Service. If you cancel your account, your Personal Data and other information may be retained in our archive or backup records.

Privacy Complaints and Inquiries

If you have a dispute or complaint about privacy on a AGI website or the Online Service, we kindly ask that you attempt first to resolve the issue directly with AGI by emailing info@AGI.org.za.

End User Agreement

This agreement (the “Agreement”) is a legal agreement between you, either an individual or a single legal entity (“You” or “you”), and Association of Ghana Industries, (“AGI”). This Agreement governs your use of AGI’s System, including any updates and accompanying written documentation provided to you (the “Products, Software or Services”).

You acknowledge and agree that AGI may occasionally contact you via email. Please see the GBBCSA AGI Privacy Policy, which is incorporated into this Agreement by reference.

Accounts, Passwords and Security

You must be a registered user to access the system. You are responsible for keeping your password secure. You will be solely responsible and liable for any activity that occurs under your user name. If you lose your password, you can reset it only through AGI’s Forgot Password email validation system.

Changes to the Products, Software or Services and Terms and Conditions

AGI reserves the right at any time to modify, suspend, or discontinue providing the Products, Services or any part thereof in its sole discretion with or without notice.

AGI reserves the right at any time to modify this Agreement in its sole discretion, without liability to you. This Agreement, as amended, will be effective upon use of the AGI System and effective for all existing users immediately after posting of any amended terms on the AGI.org.za website. You agree to be bound by this Agreement, as modified. If you do not agree to any changes to this Agreement, you must terminate your account immediately.

Please review the most current version of this Agreement from time to time, located at www.agighana.org (or such successor URL as AGI may provide), so that you will be apprised of any changes.
